Terms of Service

1. The service
Letusdify provides pre-built business automations (WhatsApp outreach, email outreach, AI assistants) on a monthly subscription basis. By creating an account you accept these terms. You must be authorized to represent the business you register.
2. Accounts and integrations
You are responsible for the accuracy of your account data and for the credentials you connect (WhatsApp Business, Google, SMTP, AI provider). You must have the right to use these third-party accounts, and you remain bound by their terms (including Meta's WhatsApp Business policies and messaging limits).
3. Subscriptions, wallet and billing
Automations are billed monthly at the price shown in the catalog, in Tunisian dinars, deducted from your prepaid wallet. Wallet deposits are made by bank transfer or approved payment methods and are confirmed manually. If your wallet cannot cover a due payment, the automation is suspended until payment. Deposited funds are refundable on written request for the unused balance; fees already consumed are not refundable.
4. Acceptable use — you must have the right to contact your leads
You warrant that: (a) you collected your leads' contact details lawfully and have a legal basis to contact them; (b) you will honor opt-outs (unsubscribe links, STOP replies) — the platform enforces these automatically; (c) you will not use the service for spam, harassment, illegal content, or messages that violate Meta's or your email provider's policies. We may suspend accounts that generate abuse complaints or violate this section.
5. Data processing (Client = controller, Letusdify = processor)
For lead and end-customer data processed through your automations: you are the data controller; Letusdify processes this data only to execute the automations you configure and on your documented instructions. We will: keep such data confidential; secure it (encryption of credentials, per-account isolation); engage only the sub-processors listed in our Privacy Policy; assist you with data-subject requests; and delete or return such data upon termination of your subscription. You are responsible for your own legal obligations toward your leads, including any declarations required of you under Law 2004-63.
6. AI outputs
AI-generated responses (assistant replies, generated templates) are produced automatically and may contain errors. You are responsible for reviewing configured messages and for your assistant's knowledge base content. Letusdify is not liable for business outcomes of AI-generated communications.
7. Availability
We aim for continuous operation but do not guarantee uninterrupted service; automations depend on third-party APIs (Meta, Google, AI and email providers) whose failures are outside our control. Scheduled runs missed due to outages are executed on the next run where possible.
8. Liability
To the maximum extent permitted by law, Letusdify's total liability is limited to the amounts you paid in the three months preceding the claim. We are not liable for indirect damages, lost profits, or actions taken by third-party platforms against your accounts (e.g., WhatsApp number quality restrictions).
9. Termination
You may cancel any automation or your account at any time; unused wallet balance is refundable per §3. We may terminate for material breach of these terms.
10. Governing law
These terms are governed by the laws of Tunisia. Disputes fall under the jurisdiction of the courts of Tunis.
